{"id":1346,"date":"2019-08-06T14:57:27","date_gmt":"2019-08-06T21:57:27","guid":{"rendered":"http:\/\/www.rula.disabilityrightsca.org\/serr\/sp\/?page_id=1346"},"modified":"2019-11-26T16:45:45","modified_gmt":"2019-11-27T00:45:45","slug":"3-10-what-are-the-eligibility-criteria-for-emotional-disturbance","status":"publish","type":"page","link":"https:\/\/serr.disabilityrightsca.org\/sp\/serr-manual\/capitulo-3-informacion-sobre-los-criterios-de-elegibilidad\/3-10-what-are-the-eligibility-criteria-for-emotional-disturbance\/","title":{"rendered":"(3.10) What are the eligibility criteria for emotional disturbance?"},"content":{"rendered":"\n<p>A student is eligible under emotional\ndisturbance if she exhibits one or more of the following characteristics, over\na long period of time and to a marked degree, which adversely affects\neducational performance:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>An inability to learn which cannot be explained by intellectual, sensory, or health factors;<\/li><li>An inability to build or maintain satisfactory interpersonal relationships with peers and teachers;<\/li><li>Inappropriate types of behavior or feelings under normal circumstances exhibited in several situations;<\/li><li>A general pervasive mood of unhappiness or depression; and<\/li><li>A tendency to develop physical symptoms or fears associated with personal or school problems. <br>[34 C.F.R. Sec. 300.8(c)(4); 5 C.C.R. Sec. 3030(b)(4).]<\/li><\/ol>\n\n\n\n<p>Your child does not have to be diagnosed\nwith or meet a clinical mental health definition of emotional disturbance to be\neligible for special education under the category of Emotional\nDisturbance.&nbsp; The federal and state\nspecial education eligibility criteria for emotional disturbance are the only\ncriteria that a student must meet to be eligible for special education\nservices. <\/p>\n\n\n\n<p>The term \u201cemotional disturbance\u201d\nspecifically includes schizophrenia, but excludes students who are \u201csocially\nmaladjusted\u201d. [5 C.C.R. Sec. 3030(b)(4).] The law does not explain what it\nmeans by the term \u201csocially maladjusted\u201d, which has caused confusion.
