In the guidance, the Department reiterates IDEA’s requirement for state qualifications in order “to ensure that personnel necessary to carry out the purposes of IDEA are appropriately and adequately prepared and trained, including that those personnel have the content knowledge and skills to serve children with disabilities.”.[1] The guidance makes clear that this requirement extends to the personnel conducting functional behavioral assessments (FBAs) that are crucial in most disciplinary cases.[2]
