When parents/guardians/other education rights holders of a student with disabilities and the school district disagree about the student’s eligibility, placement, program needs, or related services, either side can request a due process hearing. At the hearing, both sides present evidence by calling witnesses and submitting reports and evaluations to support their position. An Administrative Law Judge (ALJ) then evaluates the evidence and decides what services are appropriate under the law. A due process hearing is generally not appropriate for procedural issues, which are typically addressed through the compliance complaint process.
