(6.9) How does the CDE investigate complaints?

If both you and the district want to mediate the dispute, CDE must offer a mediation process to do so. The CDE may use the OAH mediation conference described in 6.41 to mediate compliance complaints. [34 C.F.R. Sec. 300.152(a)(3)(ii).] 

If an investigation is necessary, the CDE will appoint a compliance investigator to act on your complaint. The compliance investigator will contact you and give you the opportunity to submit additional information, either orally or in writing, about the allegations in the complaint. [34 C.F.R. Sec. 300.152(a)(2).] It is important to give the compliance investigator documents and other information to support your complaint. If you refuse to give the compliance investigator documents or refuse to cooperate in the investigation, CDE may dismiss the complaint. [5 C.C.R. Sec. 3203(b).]
