(6.59) Is the due process hearing like a trial or like being in court?

The due process hearing is not a trial. It is an “administrative” hearing and does not take place in a courtroom or before a judge. The ALJ is someone hired by the state who knows about special education law and who will impartially review all the evidence and make a decision.  [Cal. Ed. Code Sec. 56505.]
